PHISHING SCAMS – The State Bar has again received notice of several phishing/solicitation scams. Members need to be careful in responding to any email from an individual they do not know.

NEW STATE BAR ID CARDS – The Supreme Court of Appeals of West Virginia has approved the State Bar’s use of photo ID cards, issued through the West Virginia Department of Motor Vehicles, as the official State Bar identification card. To obtain the new card you will need to complete the Photo ID Membership Card Application online athttps://wvbar.org/shared/content/member_forms/photoidapp.pdf.　Print the completed form and mail to The West Virginia State Bar, ATTN: Photo ID Cards, 2000 Deitrick Boulevard, Charleston, WV 25311. Do not fax or email the form to The State Bar. When the State Bar receives your Photo ID Membership Card Application, your information will be verified and submitted to the DMV, which will assign a number to your application.　 Please note that the form you submit to The State Bar will be destroyed so your Social Security number will not be on file at The State Bar. Once that designated DMV application number is provided to you by the State Bar, you can visit any West Virginia DMV office, with an additional photo ID and $5 (cash, check, credit card or money order), and acquire your West Virginia State Bar Photo ID Membership Card.

PUBLIC COMMENT – The Court has issued an order for Public Comment on Proposed Amendments on Rules to Govern Mandatory Continuing Legal Education. Click here to review the proposed amendments.  The deadline date for public comments is February 29, 2012.

2012 WEST VIRGINIA JUDICIAL BENCHBOOK FOR CHILD ABUSE & NEGLECT PROCEEDINGS –  The 2012 West Virginia Judicial Benchbook for Child Abuse and Neglect Proceedings is now available for free download at http://wvcip.com/software-download.html orhttp://www.courtswv.gov/public-resources/child-abuse-neglect.html. A product of the Court Improvement Program of Supreme Court of Appeals of West Virginia, the 2012 benchbook contains checklists, case law, rules, and statutes relevant to child abuse and neglect proceedings.

2011 HIPAA Preemption Update – The WV Executive Branch recently updated its HIPAA Preemption analysis, which may be found at the following link:
http://www.privacy.wv.gov/privacy-program/Documents/2011%20Preemption%20Analysis.pdf   While it is produced annually to support the Executive Branch’s internal privacy compliance, it may be useful to others and serves as a database of all health information laws in WV.  Any questions may be directed to Sallie Milam, WV’s Chief Privacy Officer, at 304.558.7000 orsmilam@hcawv.org .

LAWYER REFERRAL SERVICE – Sign up now to be part of the State Bar’s Lawyer Referral Service (LRS). LRS gives you access to potential clients and also assists with providing a service to our citizens in our State who seek legal advice and counseling. Through its companion Service, the Lawyer Information Service, referrals are made to lawyers who are part of LRS. These referrals are screened and designated to go to lawyers who practice in specific areas of law and in specific geographic locations. Clients referred pay you a one time $25 fee for the consultation and in the event you take the matter, you determine the contractual relationship with your new client. The State Bar has no involvement except to facilitate the referral from the public to the Lawyer Information Service.
