WV Executive Branch Updates
The WV Executive Branch recently updated its  HIPAA Preemption Analyses which are available at this link. There is also a summary and flow chart explaining the mechanics of HIPAA preemption.  Additionally, the Executive Branch’s Privacy Requirements document was recently updated and provides a summary of all privacy laws impacting the enterprise at this link.
Both are revised annually to support the Executive Branch’s internal privacy compliance, and may be useful to others as a resource.  Further, the WV Executive Branch analyzed what personal information should be disclosed upon receipt of a FOIA request. The exception for unreasonably invasive disclosure of personal information has been the subject of much legal debate.   Click here to find a legal memorandum exploring the West Virginia Supreme Court’s decisions as well as an interactive tool to assist you in applying those decisions to your specific fact pattern.  Any questions may be directed to Sallie Milam, Chief Privacy Officer for the Executive Branch, at 304-558-7000 or at smilam@hcawv.org.
