October 13-29, 2015: The West Virginia State Bar will hold nine Regional Meetings this fall. These meetings will provide 3.0 Continuing Legal Education credits, including 2 in the areas of ethics and substance abuse. The seminars have only been approved for CLE credit in West Virginia. Lunch will be included at each meeting. Each Regional Meeting will begin at 10:30 a.m. and will last until, approximately, 1:30 p.m. The cost is $100 per person. One of The State Bar’s Officers will attend each meeting.

An Opportunity to Serve Those Who Served Our Country
The West Virginia State Bar’s Veterans and Military Affairs Committee will be hosting a webinar on Friday, October 30, 2015. The webinar will be live in Beckley and will be broadcast to the Veterans Administration Medical Centers in Clarksburg, Huntington, and Martinsburg. The webinar, which will run from 10:00 – 11:40, has been approved for 2.0 hours of general West Virginia CLE credit. Attendance is FREE but attendees will be asked to stay at the VAMC for one hour after the seminar working directly with veterans who will be scheduled for appointments at each facility between noon and 1:00 p.m. For a list of topics and speakers click here. Request for Public Comment on the Amendment to the Rules for Admission to the Practice of Law
The Court is requesting public comment on amendments to the Rules for Admission to the Practice of Law. The proposed amendment would permit the temporary practice of law in West Virginia by the attorney spouses of active service members assigned to a permanent duty station in West Virginia. The Court has approved a 60 day comment period to end on December 15, 2015. Any comments must be filed, in writing, with the WV Supreme Court Clerk’s Office.
The WV Executive Branch recently updated its HIPAA Preemption Analyses which are available at this link. There is also a summary and flow chart explaining the mechanics of HIPAA preemption. Additionally, the Executive Branch’s Privacy Requirements document was recently updated and provides a summary of all privacy laws impacting the enterprise at this link.
Both are revised annually to support the Executive Branch’s internal privacy compliance, and may be useful to others as a resource. Further, the WV Executive Branch analyzed what personal information should be disclosed upon receipt of a FOIA request. The exception for unreasonably invasive disclosure of personal information has been the subject of much legal debate.
