Attorney Supervisor

This position serves as a critical member of the Tax Division’s Legal Division, reporting directly to the agency’s General Counsel. Plans, directs, and supervises the operations of the Litigation Section of the Legal Division. Performs advanced legal work for agency; provides legal services and advice to the Tax Commissioner, Deputy Tax Commissioner, and General Counsel in the evaluation, planning, and implementation of Tax Division policy within statutory and decisional law guidelines. Provides internal guidance to agency staff regarding law, policy, and precedent; may also discuss legal matters with taxpayers, tax practitioners, representatives of state and local governmental agencies in and outside of West Virginia, and representatives of the Internal Revenue Service and other federal entities when required. Plans, assigns, directs, and supervises the legal work of staff attorneys and paralegals. Provides oversight and review of document preparation for legislation, correspondence, administrative notices, regulations, Freedom of Information Act responses, responses to subpoenas and ex parte orders, and other legal and technical documents. Composes and revises written materials such as legislation, regulations, Tax Division correspondence, administrative notices, technical assistance advisories, Tax Division publications, internal memoranda, press releases, legislative abstracts, and Freedom of Information Act responses. This involves significant legal research. Communicates regarding legal matters with taxpayers and their representatives, such as legal counsel, Certified Public Accountants, taxpayer corporate officers, etc. Performs related work as required.

Employment requires a fingerprint-based criminal-background check to be provided at the West Virginia Tax Division’s expense. Failing to initiate the process or cooperate with this process, providing false or incomplete information, or discovery of disqualifying information will result in denial of, or dismissal from, employment or denial of transfer irrespective of when discovered. The chosen applicant will also be subject to a tax compliance check.
