Ryan Johnson, the Standing Chapter 13 Trustee for the State of West Virginia is accepting applications from qualified individuals for employment as a staff attorney. The staff attorney assists the Trustee in complying with all provisions of the United States Bankruptcy Code and Federal Rules of
Bankruptcy Procedure and in complying with the instructions of the Bankruptcy Courts for the Northern and Southern Districts of West Virginia. The staff attorney assists in meeting fiduciary duties which require the diligent exercise of good faith and loyalty in the administration of estates in Chapter 13 cases.
The Staff Attorney is an “at will” employee.
Primary Duties of the Staff Attorney are:
• Acts as the Trustee’s representative at Chapter 13 hearings and 341 meetings.
• Reviews, approves, responds or objects to all matters arising in Chapter 13 cases.
• Investigates the financial affairs of debtors including review of debtor’s tax returns, bank statements and liquidation analyses.
• Works with staff to ensure compliance with Trustee Handbook, Bankruptcy Code, and Local Rules.
• Works closely with the Trustee and staff in drafting legal pleadings, letters, memorandums, and other legal correspondence.
• Serves as a legal resource to the staff for all phases of Chapter 13 case administration which require legal knowledge, expertise, and authority.
• Travels, as necessary, to attend court proceedings in Wheeling, Clarksburg, Elkins, Martinsburg, Charleston, Beckley and Huntington, West Virginia.
• Conducts other duties as assigned.
Minimum Qualifications are:
• Qualifications for membership in good standing with the West Virginia State Bar.
• Qualifications for admission to the Federal District Courts for the Northern and Southern Districts of West Virginia.
• Sufficient computer skills to effectively utilize the Chapter 13 case management software, Microsoft Office software, Excel, Pacer, and CM/ECF applications.
• Oral communication skills.
• Proficiency in legal writing and analysis.
• Genuine interest in the subject of federal bankruptcy law.
Conditions of Employment
- The position is subject to mandatory EFT (Electronic Funds Transfer).
- Candidates selected for interview may be subject to a background investigation.
- Employment is provisional for the first 90 days.
- Employees are considered “at-will” employees.
- Applicants selected for interview must travel at their own expense.
- Only those candidates interviewed will be notified of the selection outcome.
- Relocation expenses are not authorized.
