Legal Aid Requests Your Help
Legal Aid of West Virginia has been designated to receive 50% of residual funds from class actions, pursuant to an amendment to W. Va. R. Civ. P. 23, effective March 8, 2017. We need your help to determine how many class action lawsuits may be in the pipeline. If you are in a class action, please let us know by emailing the name of the circuit court and case style to Joshua Rodgers at jrodgers@lawv.net. These funds are very important to vulnerable West Virginians. Thank you.
State Tax Department Website Upgrades
The State Tax Department has made upgrades the their website which will provides more information for tax payers and tax practitioners. A new feature invites the public to join the Tax Commissioner’s Office Mail List. This will allow the office to send subscribers a “no response” email. The system is operational and has already been used to send out emails regarding four proposed legislative rules which are out for public comment and one announcing issuance of Administrative Notice 2017-2018, regarding the increase in the motor fuel excise tax that takes effect this month. 23rd Judicial Circuit Vacancy:
The Judicial Vacancy Advisory Commission is currently receiving applications to fill the judicial vacancy on the 23rd Judicial Circuit Court serving Berkeley, Jefferson, and Morgan Counties. Candidates must submit their completed applications by no later than 5:00 p.m. on July 25, 2017. The deadline for submission of letters of recommendation or comment is August 4, 2017. The United States Bankruptcy Court for the Southern District of West Virginia has drafted a proposed Model Chapter 13 Plan for use in the southern district of West Virginia. The proposed Chapter 13 Plan is available on the Bankruptcy Court’s website (www.wvsb.uscourts.gov) or can be requested by sending a written request with a self-addressed stamped envelope, to the Bankruptcy Clerk’s office address below. Public comments on the proposed Model Chapter 13 Plan will be accepted through Monday, August 17, 2017, and can be filed by emailing the comments to wvsbml_cm_notice@wvsb.uscourts.gov or by mailing comments to the Bankruptcy Clerk’s office at:

Proposed Amendment to Rule 9 of the Rules for Admission to Practice of Law
The Supreme Court of Appeals is seeking comment on a proposed amendment to Rule 9.0 of the Rules for Admission to the Practice of Law. Rule 9.0 of the Rules for Admission to the Practice of Law governs limited permission to practice in association with an approved legal services organization or public defender program. The rule currently limits practice under this provision to a total of thirty-six months. The proposed amendment extends the time to five years, which would coincide with the time frame required for admission through reciprocity. Public comments on the proposed change to Rule 9 will be accepted through July 31, 2017.
Proposed Amendment to Rule 5 of the Rules of Criminal Procedure for Magistrate Courts
The Supreme Court of Appeals is seeking comment on a proposed amendment to Rule 5 of the Rules of Criminal Procedure for Magistrate Courts. The proposed amendment provides for regular review of compliance with bond conditions in cases involving allegations of domestic violence. Public comments on the proposed change to Rule 5 will be accepted through July 31, 2017.
