Call for Judges: 2020 National Energy and Sustainability Moot Court
The National Energy and Sustainability Moot Court Competition, hosted March 5-7 by WVU Law, is seeking volunteer judges. Early round judges must be attorneys of good standing licensed to practice law in any state. Final round (March 7, afternoon) judges must be a federal or state appellate judge. Now in its 10th year, the National Energy and Sustainability Moot Court Competition attracts exceptional law students from across the country. A record 36 teams are signed up to compete this year. The Supreme Court of Appeals of West Virginia entered an Order, on December 30, 2019, Approving and Adopting the Revisions to the Governance Documents of the West Virginia State Bar – West Virginia State Bar Constitution, West Virginia State Bar Bylaws, West Virginia State Bar Administrative Rules, and Definition of the Practice of Law
During the next few months, The State Bar will hold several short informational seminars to familiarize members with the revised Bylaws.
Two-Year CLE Reporting Period Ends June 30, 2020
The CLE reporting is to be completed electronically using the web-based membership portal at www.mywvbar.org. A minimum of 24 credits, including at least 3 credits on legal ethics, law office management, attorney well-being or elimination of bias must be reported. Below are some basic helpful hints to get you started.
Make sure you know your username and password for the online portal. You can request a new password from the login screen.
Check your current CLE transcript for accuracy. Once you are logged in to the portal, go to the “CLE” tab and choose “My CLE Transcript” from the dropdown menu.
If you have already attended/completed a CLE course for the 2018-2020 reporting period – report it now and do not wait until the reporting deadline.
Confirm any pending attendance credits that have been reported by a CLE provider and appear on the bottom of your transcript waiting for your approval.
NON-LAWYER REPRESENTATION
IN ADMINISTRATIVE HEARINGS
On September 3, 2015, public hearings were held before the State Bar’s Unlawful Practice of Law (UPL) Committee on concerns that had been received regarding non-lawyers representing claimants before state administrative agencies. In July 2018, the UPL Committee submitted a report to the West Virginia Supreme Court regarding the Committee’s findings on non-lawyer representation of claimants in various administrative proceedings. By letter dated November 19, 2019, the Supreme Court declined to adopt the recommendations in the report citing the statutory authority for non-lawyers to represent individuals before various state administrative agencies. The Court advised that, absent an actual case or controversy being presented before the Court, the Court would not entertain a challenge to the statutory authority.
The State Bar will make the report and Supreme Court response available upon written request to Anita R Casey, Executive Director, The West Virginia State Bar, 2000 Deitrick Blvd., Charleston, WV 25311.
Interest Rate for 2020
The Administrative Office of The Supreme Court of Appeals of West Virginia has set the interest rate at 4.75 percent for judgments and decrees entered during the 2020 calendar year.
