Nature of Work
The West Virginia Public Employees Grievance Board is seeking a qualified individual to perform professional legal work involving grievance-related mediations, quasi-judicial hearings, and the preparation of formal written decisions in complex employment-related matters.
Responsibilities include ensuring that all parties are afforded substantive and procedural due process through the proper scheduling and conduct of hearings, management of the official record, legal research, findings of fact and conclusions of law, and the issuance of written decisions in accordance with applicable statutes, rules, and regulations. The position requires the ability to preside over formal proceedings fairly, impartially, and professionally while maintaining appropriate judicial temperament.
Knowledge, Skills, and Abilities
Knowledge of West Virginia law relating to rules of evidence, pleadings, due process, and administrative proceedings.
Knowledge of constitutional and administrative law applicable to agency proceedings.
Knowledge of legal research methods and techniques.
Knowledge of statutes, regulations, and judicial and administrative decisions interpreting applicable law.
Knowledge of procedures and standards governing formal legal hearings and proceedings.
Ability to preside over formal hearings involving complex or controversial issues with fairness, authority, and professionalism.
Ability to establish and maintain effective working relationships with the public, attorneys, agency representatives, and court officials.
Strong oral and written communication skills.
Minimum Qualifications
Graduation from an accredited law school and admission to the West Virginia State Bar, with experience in administrative law, employment law, litigation, mediation, or related legal practice preferred.
Experience
Three years of full-time or equivalent part-time paid experience as an attorney, including trial experience, or experience as a hearing examiner, administrative law judge with an administrative body, or judge of a court of record.
